Data Privacy: Federal High Court of Nigeria Orders Zoom to be Served by e-mail

Trustees of Laws and Rights Awareness Initiative has filed a data privacy suit against against Zoom Video Communications Inc. the operators of zoom video conferring app at the Federal High Court of Nigeria in suit no. FHC/AB/CS/53/2020 for the enforcement of zoom users’ data protection and privacy rights.

In a suit filed on behalf of the NGO by the firm of Olumide Babalola LP, the Applicant which sued for and on behalf of its members, alleged that, Zoom stated in its privacy policy that, it is a data processor as opposed to a data controller and that its privacy policy violates the provision of the Nigeria Data Protection Regulation 2019 and therefore liable to be fined by the supervisory authority – National Information Technology Development Agency (NITDA).

Due to the COVID-19 pandemic, serving the originating processes on Zoom at its California office has become impracticable hence the Court ordered the processes to be served on them via their email in order to put them on notice of this suit. The matter has been adjourned to 16th day of July for further proceedings.
