Shamsudeen Musa, Esq. was arrested and detained since 6th May, 2022, over a client’s matter gone wrong—that he prepared a Deed of Assignment (legal instrument) for his Client in respect of a sale transaction and the Police are investigating the money used to purchase the property.
According to information available to us, Mr. Shamsudeen has been in police detention (FCIID Area 10, Garki Abuja) after he was arrested in Kano State and brought to Abuja together with his client and some policemen.
In the Enforcement of his Fundamental Rights suit, the High Court of FCT on 25/07/2022 in Suit No. FCT/HC/CV/2443/2022 Motion No. M/9380/2022 Between Shamsuddeen Musa vs. IGP & 9Ors before his lordship, Hon. Justice Eleojo Enenche (Vacation Judge 3), the court made an order directing the Nigeria Police (Respondents in the matter) to grand bail to Mr. Shamsuddeen Musa (Applicant). All the Respondents were duly served with Order of Court.
The police has refused to obey the court order.
The FCT High Court issued form 48 to commence contempt proceeding against IGP and DIG (FCIID) for disobeying court order to release Shamsuddeen Musa, Esq.
Mr Musa’s associates have repeatedly called on the NBA President, Olumide Akpata and the NBA-Security Agencies Relations Committee to intervene and secure his release to no avail.
“Sir, it is my strong opinion that his detention for more than 24-48hours as clearly provided by our ground norm is illegal and unconstitutional. Moreso, the section of ACJA, 2015 which police officers always rely on to detain suspects for more than what the Constitution provides is inconsistent with our constitution and therefore null and void.” a colleague said.
Based on the foregoing, Mr. Shamsudeen’s close associates and other concerned members of the bar, again, call on the NBA President and other national officers to use their good offices to secure the release of the detained lawyer in line with the bail order.
