· Defendant not serious with settlement, says Lawyer
A Consultant Otolaryngologist at the State House Clinic, Aso Rock, Abuja and one of the Ear, Nose and Throat Surgeons to President Muhammadu Buhari, Dr Sherifat Hassan has sued the British Airways, the flag carrier airline of the United Kingdom over allegation of breach of contract of carriage by air. Dr Sherifat had filed the suit at the Federal High Court through her lawyer, Abdulmajeed Oloriegbe, Esq with SUIT NO: FHC/ABJ/CS/1119/2021.
In the writ of summons, a copy of which was sighted by our correspondent, Dr Sherifat and two of her children are asking the court to declare that the BA breached contract of carriage by denying them access to board airline without prior notice despite fulfilling all requirements needed for their trip to Los Angeles, USA for vacation and some personal functions and that BA’s conduct in so doing is oppressive and illegal. The Claimants are also asking the court for $15,000 as damages for the alleged breach.
On the last time the matter came up being 6th December, 2021, the Plaintiff was present in Federal High Court 6, presided by Hon. Justice I. E. Ekwo and was represented by a counsel in the law firm Oloriegbe & CO, M. I. Arikewuyo while BA was represented by Zaid Jubril, a lawyer from the chambers of J. B. Majiyagbe & Co. Jubril had informed the court that BA has approached the Plaintiff for an amicable settlement and leave was granted by the court for same to be explored while the matter was adjourned until 3rd February, 2022 for report of settlement.
According the Plaintiff’s counsel however, Abdulmajeed Oloriegbe, Esq, while it is true that BA approached his client for settlement and that in fact, he had discussed with BA’s lawyer, Folorunsho Majiyagbe SAN but beyond that, nothing serious has come out of the discussions and without any positive move to have the matter settled, the Plaintiffs will have no other option than to proceed with the hearing of the case.
