Federal High Court Moves to Enforce Stricter Compliance with Rule on Affidavit of Non-Multiplicity of Action


The Federal High Court has restated its drive to preclude multiple suits in civil proceedings by demanding that an Affidavit of Non Multiplicity of Action are attached to Writs of Summons, Originating Summons and petitions at the commencement of actions vide the Order 3 Rule 3(1)(f), Order 3 Rule 9(2)(d) and Order 5 Rule 2(2)(d) of the Federal High Court (Civil Procedure) Rules 2019.

TO: Deputy Chief Registrars/ All Station Registrars

 CIRCULAR

I am directed to inform you to comply with the provisions of Order 3 Rule 3(1)(f), Order 3 Rule 9(2)(d) and Order 5 Rule 2(2)(d) of the Federal High Court (Civil Procedure) Rules 2019 to the effect “that all civil proceedings commenced by either Writ of Summons, Originating Summons or Petitions, must be accompanied by an Affidavit of Non-Multiplicity of Action on the same subject matter”.
