MAN Nasarawa Branch restates Demand for Improved Welfare for Magistrates

Leadership of the Magistrates’ of Nigeria, Nasarawa branch during the courtsey call to the Executive Secretary of the State’s Judicial Service Commission

The Magistrates Association of Nigeria, MAN, Nasarawa State branch has reiterated the call for better welfare policies, including improved security, for Magistrates in the state.

Chairman of the Association, Mr Abdullah Hassan Shams Shama said this during a courtsey visit to the Executive Secretary of the Nasarawa State Judicial Service Commission, Mrs Hafsat Sanda on Tuesday.

The Chairman’s Message

It is with great pleasure we bring to you good tiding on behalf of Magistrates’ Association of Nasarawa state (M.A.N), it is with great joy we inform you that after a keen contest but peaceful outcome of election held on the 4th may , 2019 at High court 4 Lafia, Nasarawa State in which the following persons emerged as the officials to pilot the affairs of MAN Nasarawa State branch.

Commending the Commission for its glaring efficiency, the Chairman congratulated the officials for discharging the responsibilities they are saddle with, and for taking the giant stride of moving to the Commission’s permanent site.

His Worship delved into the powers of the commission ‘as spelt out in 1999 constitution. He stated that by virtue of Section 197 Part ii (b) and (c ) of the third schedule:

Policy formulation and implementation: The commission is saddled with the responsibility of making policy for the state judiciary with the sole aim of achieving sustainable growth and development.

Budget: The commission harmonize the capital and recurrent expenditure of the different arm of the state Judiciary”

“In light of the above we pray that the harmonization of condition of service of Magistrates, Draftsmen, state counsel , Area court Judges, Members and Inspectors Law 2015 be giving a top most priority as it will go a long way in enhancing quality in the administration of justice in Nasarawa state.

“We passionately appeal to the commission to revisit the position of non remittance /deduction of check up due, which was as a result of the ampere / crisis of JUSUN. (Nasarawa state branch). We wish to re-echo that Magistrates Association of Nigeria did not joined the strike even though it affected its members from effectively carrying out its duties. We plea for re-instatement of the deduction which will enable us pilot the affairs of the association. Indeed no association can function without funds.

The welfare of the magistrate is our paramount concern, we further plea on the way forward to enable us actualize the implementation of the harmonization of condition of service of magistrates Law passed. We seek for the implementation by Executive Fiat. The execution of the law will be a novel provision, Lagos State had done it. The Magistrates Court law gave the Lagos state Judicial service commission extra constitutional powers outside its constitutional mandate including :-
a. Power to divide
b. Constitute
c. Distinguished and vary the limit of magisterial district in the state
d. Power to establish magistrate courts house in the state
e. Power to approve official seal of magistrate
We shall constantly be knocking on your door in order to actualized the implementation.

In line with some of the agenda of the present Exco which we intend to pursue with your support and corporation are as follows:-
a. Secretariat /Office for M.A.N
b. .Duty travelling allowance for official duties in likes of prison visits, sitting on fiat cases and when invited officially.
c. .Upward review of dressing allowance pending the implementation of the harmonized Law.
d. .Improve number of magistrates and monetary package to attend workshops and seminar.
e. .Sallah and Christmas packages to have magistrates at heart and action.
f. Revolving loan emphasis on magistrates to the tune of two million naira least (N2,000,000:00k).
g. Grant of at least three hundred thousand naira N300,000 which will assist in running the association.

We appreciate the chairman J.S.C./Chief Judge of Nasarawa State who deem fit to provide all magistrates with lap top for easy research . However in other to be fully connected, may we pray that a modern /wifi be provided for ease of connectivity. We commend the web site open by the J.S.C. Further called that same be updated in terms of event and seniority list posted. As it is today we have 46 sitting magistrates in Nasarawa state in addition to chief Registrars and Deputy Chief Registrars’

We pray that more offices /Departments be established in High court ,Sharia court of Appeal and Customary court of Appeal as applicable in other jurisdiction to enable magistrate grow within the system. We may suggest the following:
a. Deputy chief Registrar Magistrate courts
b. Deputy chief Registrar Area courts
c. Deputy Chief Registrar Special duties
d. Deputy Chief Registrar Probate
e Deputy Chief Registrar Superior courts
f. Deputy Chief Registrar Litigation and Library service
g. Deputy Chief Registrar Personnel
h. Deputy Chief Registrar Planning ,Research and statistics

We further pray you cause the commission that in appointment to Higher bench we passionately appeal that preference to sitting magistrates in the appointment to the Higher bench.

We call on the Commission to prevail on the state Government to establish borstal homes and remand institution as a way of taking care of juveniles and preventing their abuse.
We pray that our security needs will be effectively addressed.
Our prayer and hope is that our tenure will be successful and by Allah’s grace shall leave same better than we met it.
We are all stake holders and collectively
